DMCA policy

How to report copyright infringement and how I handle takedown notices.

1. Introduction

I respect the intellectual property rights of others and expect my users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), I will respond expeditiously to claims of copyright infringement that are reported to me.

2. Content licensing

Images and media content on this website are either:

  • Licensed through my Unsplash subscription
  • Created by me
  • Used under appropriate Creative Commons licenses
  • Properly licensed from other stock photo providers

If you believe I have incorrectly attributed or used any content, please contact me immediately at ishan@techearl.com so I can address the issue.

3. DMCA notice requirements

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on my website, please send a written notification that includes:

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material claimed to be infringing (with URL or specific location)
  • Your contact information (name, address, telephone number, and email)
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf

4. How to submit a DMCA notice

DMCA notices can be sent to me at ishan@techearl.com. Please include "DMCA Notice" in the subject line. I will process and investigate notices of alleged infringement and take appropriate actions under the DMCA.

5. Counter-notification

If material you have posted has been taken down due to a DMCA notice, you may submit a counter-notification if you believe the material was removed by mistake or misidentification. Your counter-notice must include:

  • Your physical or electronic signature
  • Identification of the material removed and its previous location
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
  • Your name, address, phone number, and consent to federal district court jurisdiction

6. Repeat infringers

I take copyright violations seriously and will take appropriate action against repeat infringers, which may include permanently blocking their ability to comment or interact with the website.

7. Fair use

I respect fair use principles under copyright law. If you believe your use of copyrighted material constitutes fair use, you may include this in your counter-notification with an explanation of why your use is permissible.
